West Virginia credit and debt laws

Short answer

In West Virginia, the statute of limitations on written contracts is 10 years. That clock limits lawsuits, not credit reporting: under federal law, most negative items leave your credit report after 7 years no matter which state you live in.

Type of debtTime limitLaw
Written contracts10 yearsW. Va. Code 55-2-6
Oral contracts5 yearsW. Va. Code 55-2-6
  • Written contracts. Applies to a written contract signed by the party to be charged or that party's agent.
  • Oral contracts. The five-year period covers any other contract, express or implied.

Time limits to sue vs. time on your credit report

The West Virginia deadlines above control how long a creditor or collector can win a lawsuit. They don't change how long an account stays on your credit report. The federal Fair Credit Reporting Act limits most negative items to 7 years in every state, counted from the date of first delinquency, and a payment doesn't restart that reporting clock. See how long negative items stay for both clocks side by side.

Can a payment restart the clock?

Only a signed writing revives a debt. A written promise to pay, or a signed acknowledgment from which a promise to pay can reasonably be inferred, lets the creditor sue within the original period counted from the promise (W. Va. Code 55-2-8).

Does West Virginia limit lawsuits on old debt?

West Virginia requires a disclosure. When a debt is past the deadline for filing a collection suit, every written communication from the collector must say that the law limits how long you can be sued and that the owner can't sue you because of the debt's age. If the debt is also past the credit reporting period, the notice must say it can't be reported to any credit reporting agency (W. Va. Code 46A-2-128(f)).

Medical debt on credit reports in West Virginia

West Virginia has no law of its own limiting medical debt on credit reports, so the national rules decide what shows. The three bureaus leave off paid medical collections and any under $500, and an unpaid one can't appear until it is a year old.

Marriage and debt

West Virginia is not a community property state. Each spouse keeps a separate credit report, and a debt generally belongs to the people who signed for it.

Do debt collectors need a West Virginia license?

Yes. A collection agency must be licensed through a business registration certificate, keep an office in the state, and file a $5,000 continuing surety bond for each office with the Tax Commissioner (W. Va. Code 47-16-4).

In West Virginia, complaints about debt collectors and credit reporting can go to West Virginia Attorney General, Consumer Protection Division, as well as to the Consumer Financial Protection Bureau.

More to know in West Virginia

West Virginia gives creditors ten years to sue on a written contract signed by the debtor (W. Va. Code 55-2-6). Contracts that are not in a signed writing get five years. That makes the paperwork matter. A collector suing on an account it can't tie to a signed agreement may be limited to five years. West Virginia's Consumer Credit and Protection Act requires a specific notice on time-barred debt. Every written communication about a debt past the lawsuit deadline must tell you the owner can't sue you because of its age, and must also say whether the debt can still be reported to credit bureaus (W. Va. Code 46A-2-128(f)). A letter about a very old debt that leaves this out is a violation of state law. Only a signed writing revives an old debt under 55-2-8, so a spoken promise on the phone does not. Collection agencies must hold a state license and post a $5,000 bond per office with the Tax Commissioner (47-16-4).
